I hear they will try again to attach the provisions to other bills. Hopefully we will jump in too. Kudos to iv's efforts. If I can sit pretty for the moment with a 485 filed it's thanks to IV. Please keep going.

As I understand, we would receive emails in this order: approval email, cpo email and then a welcome email

    Guys,
Thanks for the responses...My email as you see in the first message is neither "Welcome" nor a CPO.

So am I unique....unwelcomed approval.....strange...even in this there is no standard format or routine....

What would be considered STEM? Would all professional that are eligible for H1B such as an Accountant or an MBA in Finance or Marketing be considered STEM? Or its just S T E M?

Thats great news, berkeleybee. You should probably point out that several members may have contributed hundreds or even thousands of dollars,
    (including the core team.)

This is a great achievement. I deeply respect the involvement and the efforts of the core team members.

    :)

    Hi,

I need to draw the IV website admin's attention to a minor style sheet issue which is making the site look a little bit "wonky" in Internet Explorer 6.0.

The CSS needs to be adjusted, as the "Contributions section" in the right most column is appearing midway on the page instead of way up top like it should in the other browsers.

I am trying to attach the image but it seems like I cannot attach anything with an image width of > 800 or an image height of 600.

Anyone who has H1B extension and AP and EAD ....it is better to have H1B stamped on passport and use the same to enter US....do not listen to others....

It is up to you if you entend to use H1B stamp or AP....the POE officer cannot force you to use AP or H1B stamp...carry all the documents with you.

THe best thing about getting H1B stamped is that in case of 485 rejection you can still be on H1B and file for reopening your case. Peace of mind is the key here

Its NATIVE INDIAN AMERICANS not 'RED INDIANS'. The term you used is considered derogatory by many.

This should also act as an eyeopener for those people on H-1B who are just about now starting their GC process. Such people can forget getting a GC for the next 12-15 years.

If you are young (in late 20s), you should reevaluate this whole idea of coming here on EB GC. It maynot be worth the wait and the suffering.

I think I will change my ID to "(Non)Eternal_Hope"

    Hi,

I am on L1A managerial category currently in USA for my 5th year with company A. I know if company A files my GC I can apply under EB1 category.

But, if a future employer B files my GC can they file it under EB1? Additional info - The future employer is a big MNC and has offices in USA. I am a graduate in engineering with about 10 years of experience. The future employer B is not linked in any way to A.

If B cannot file under EB1 what category can they file my GC in? And when would I be able to start working for B?

    Thanks in advance.

All three options put a dent in your life. But I guess the golden period of life is over, remaining period of life will go raising your kids, looking after your parents. Sometimes I like the American culture a lot; you get to enjoy all life long!

American culture as we know it maybe ending. Social security will not be enough to support the baby boomers and many will end up being a burden on their children. In a way, we always have an option of going back to india but for americans?.

Our Hard Quota Memo (in our Resources section) is now posted on the widely read Bender's Immigration Bulletin http://bibdaily.com/index.cgi

Before we created this memo, this fact was not widely known and we are doing our best to get the word out.

I am in a tricky situation. Filed concurrent I-140 and I-485 (Schedule A Group 2..exceptional ability in the arts and science) ... 8/2006.
In the meanwhile a labor cert as well- PD 8/ 2004 was approved in 2006 and I recieved an updated I-140 using the old priority date, ie. 2004. Now after 2 years the TSC is adamant that my PD is 2006 not 2004 and have given me yet another "corrected" I-140 with 2006 PD.

One lawyer said I could cite "affirmative misconduct" and request the supervisor of the I-140 section to consider and accept the late filing on the basis of affirmative misconduct. If not for the earlier I-140 with 2004 PD we would have filed another I-140. So their affirmative mistake cost us 2 years in a category so backlogged already. (I am EB 2 India).

My lawyer says we will not win and does not want to do it. Any advice?

    Happy Diwali to all.
Here is the Diwali story as told in 21st Century in US by Indians.
    *
    *
A young second generation Indian in the US was asked by his mother to explain the significance of "Diwali" to his younger brother, this is how he went about it...
    *
" So, like this dude had, like, a big cool kingdom and people liked him. But, like, his step-mom, or something, was kind of a bitch, and she forced her husband to, like, send this cool-dude, he was Ram, to some national forest or something... . Since he was going, for like, something like more than 10 years or so.... he decided to get his wife and his bro along... you know...so that they could all chill out together. But Dude, the forest was reeeeal scary shit... really man...they had monkeys and devil s and shit like that. But this dude, Ram, kicked with darts and bows and arrows... so it was fine.
    *
But then some bad gangsta boys, some jerk called Ravan, picks up his babe (Sita) and lures her away to his hood. And boy, was our man, and also his bro, Laxman, pissed... all the gods were with him... So anyways, you don't mess with gods. So, Ram, and his bro get an army of monkeys... Dude, don't ask me how they trained the damn monkeys... just go along with me, ok...
    *
So, Ram, Lax and their monkeys whip this gangsta's ass in his own hood.... Anyways, by this time, their time's up in the forest... and anyways... it gets kinda boring, you know... no TV or malls or shit like that. So,they deci ded to hitch a ride back home... and when the people realize that our dude, his bro and the wife are back home... they thought, well, you know, at least they deserve something nice... and they didn't have any bars or clubs in those days... so they couldn't take them out for a drink, so they, like, decided to smoke and shit... and since they also had some lamps, they lit the lamps also...so it was pretty cooool... you know with all those fireworks... . Really, they even had some local band play along with the fireworks... and you know, what, dude, that was the very first, no kidding.., thatwas the very first music-synchronized fireworks... you know, like the 4th of July stuff, but just, more cooler and stuff, you know. And, so dude,
that was how, like, this festival started."

Sentiments aside, at least you could have got the story right. That is not why Diwali is celebrated. So, may be get the story correctly before even trying jokes.

    What is "Letter of Acquirement’

Can you please tell me what is "Letter of Acquirement’'

My company is Acquired too, the New Employer just gave me a Letter Copy
explaining the Merger, NO Official docs were shared with me.

From whom did u get this letter.

No need of new H1 if company 'B's' HR has agreed to continue with 'A''s employees.
    1. Get a EVL letter from company 'B'. (This is assuming name of 'A' will change to 'B' or new name.

    2. You need to get a "Letter of Acquirement" from HR of new company (I am assuming that the name of the company is changing as well). If name does not change then you should be fine. If you have to travel out of US, you need to carry latest copy of EVL(of new company) and "Letter of Acquirement" along with you. (I went thru these few years back, PwCC bought over by IBM, immediately after the takeover I travelled out of US and came back without any problems(on H1)) this was quite a while back though, you may want to check with your company attorney though.

    Note:
"Letter of Acquirement’ would state that your 'A' company was bought over by 'B' company on Date and name has now changed to 'B'.

    Good luck.

Yes, it won't be a rejection or a denial either...just a simple RFE. Since both the names on the marriage certificate are different from the applicant (you) and the beneficiary (your wife), USCIS should be able to deduce that it's a mistake.

    Thanks,
    Jayant

The title is in Hindi and it means "Labor is on sale, do you want to buy it?" The hindi line is taken from a very famous hindi song of 80s that says "groom is on sale, do you want to buy it?"

    Hi Guys,
Need some help. I have labor via PERM(EB2) and I-140 from my present employer. Labor was filed in December 2005. I had applied for Labor by RIR in Sep 2002 from my previous company which closed down in 2004. The old company's attorney has contacted me that the labor is approved. That labor was under EB3.

Both companies are engaged in similar operation, job profile now is more than previous company and both companies are in the same demographic area. Can I port my PD and retain EB2. If I can do that I can file I-485 now.
Any advice will be greately appriciated.
