It reminds me this story every time I visit IV.
Workers working with an export company which use to ship chickens from all over the world to US/Europe, were packing chickens from some Indian port. Each box was having some 50-70 chickens in it .
After loading them in, they were about to cover these boxes with the tops. The leader shouts to workers: " No need to put the tops. They wouldn't go any where "
Surprised with this order, one worker asks the leader 'Why'. The leader says : " These are Indian chickens. IF one tries to escape, other will pull its leg."

He is not talking about Indians, rather he talks about H1b in general. Since India does not have equivalent social security system, US Govt and Indian Govt did not sign any contracts. Other countries like Canada / UK / AUS have mutual agreement between them and US for transferring the social security paid in US to be transferred to their home country if the alien returns to the home country.
Even Indian Govt (P.Chidambaram) I beleive is working with US Govt to get these SS paid by Indians who have returned back to India. Since the US system and Indian system does not allow with the current rules and regulations to transfer the amount, it is stalled. may be down the line even India would work with US to get these amounts back.

That is so TRUE! Ask me I finished my undergraduate from US, and I didn't get selected in the H1 lottery system 3 times, yes 3 times. Neither my wife's labor was cleared in July fiasco. So imagine my situation.
So,
who do I blame? US govt? Or these Desi companies who have exploited H1B system to the core, abusing the system and making our lives miserable each day. Well I am about to join an organization, which will report these Desi companies straight to Department of Commerce, there are a group of students from other Universities who are planning to be a part of the organization.

Generally consultants are highly competitive than the so called "permanent" employees. Many US graduates are employed due to some agreement between the universities and companies. During my consulting career, I have seen so many mediocre permanent employees who were hired just because they graduated from some XYZ US university.
I had a colleague who was PHD in computer science from some US university. His main topic of PHD, "parrallel processing". He didn't even have a proper understanding of different POSIX thread calls which he used for his PHD. That is the value of a US degree or PHD. Your degree is only as good as you !
I have been seeing many members talking about taking on consulting companies so that they can get better chunk of H1B visas. If you are that smart, go ahead and lobby for GC exemption for US graduates.

When I called Lucille Raybal Allard's office last week, a rep from the office had an extensive conversation with me about both the bills and they have not heard about them before. He recognized me when I called him back to check if they made a decision.

bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it :)

Listen we are giving our hard earned money to this group, we beleive that they are the only ones fighting our cause. Can you please name one more org/group that is doing the same. The industry that includes esteemed Bill Gates wants more H1bs, no on talks about our releief. What open mind are you talking about? Get a reality check. We are not a frat house here that we are applauding each other. We want constructive criticism... e.g. if you think you are a better leader step up and say you can do x, y, z.
If you cannot give contructive critisim then the rest of us would appreciate that you don't vent ur frustrations here, because see how much harm you do by making us respond to your personal frustrations.

It is important to know that despite of severe visa retrogression and random visa cutoff date movements, USICIS or DOS hasn�t released any official information on how many Adjustment of Status applications are pending at USCIS under various categories which leaves thousands of AOS(Adjustment of Status) applicants in complete darkness and dependent on guessing games by various Law firms.
A green card application requires enormous amount of efforts and money from the beneficiary and his/her employer. People who are waiting for 7-8 years now would have had already spent average $15,000-$20,000, in maintaining their statuses and keep the Green Card process going on. Being stuck in a green card process keeps us bonded with 1 employer, job type etc.
We need to know if there is any light at the end of the tunnel. We need to know for how long we have to live our life in limbo. If there is hope than we need to be patient and plan to live like that for another 1-2 years. But if there�s no light at the end of the tunnel than we need to move on with our careers and other family commitments. Only your office and USCIS can help us by releasing statistics on the number and categories of applications pending with USCIS people waiting in this category can plan their lives accordingly.
It will be a great help if DOS or USCIS could tell us about the number of AOS application pending at USCIS along with their Categories(EB-3, EB-2, EB-1) and chargeable country.
We have been waiting for a decade and continue to wait would it be reasonable to request you for some guidance with regards to the Visa allotment. I request your office to provide some statistics on home many Adjustment of Status applications are pending at USCIS.

nope, if the alternative to the GC system is outsourcing (as you yourself mentioned) all the profits go to big corporations and our salaries are spent in India. The corporations are notorious for avoiding taxes so teh government gets nothing. By making us stay here longer (on H1 or GC) we end up spending our salaries here, paying taxes, paying social security, paying medicare.
65K H1-Bs earning 70k a year is 4.5 billion dollars. 140K new GC holders each year earning the same comes out to 10 billion dollars. Out of that taxes alone are an easy couple of billion or more dollars. Then take into account the side-effect (we buy cars, we buy appliances, we rent apartments) and the contributions we make to this economy are a lot.
And to say that we are stealing jobs is also inaccurate. There is nothing called stealing-a-job. In general every job is worth how much someone is willing to be paid to do it. If an American citizen wants 100K and the GC holder wants 90K and the H1-B visa guy wants 80K (and all of them are going to work in the same city and same office) the job is worth 80K. The H1-B visa holder is not stealing a job. The days of knowing HTML tags and commanding a salary of 100K a year (1999-2000) are long gone and now replaced by 'that kind of work gets done in India or Ukraine for 10k a year'. Looking at the resumes we got in response to job ads placed in the last 3 companies I worked for, there are simply not enough qualified americans interested. Thats a fact. So the IT sector needs help from abroad to get the job done. They can either send the work over, or bring the people here. Bringing the people here also benefits the rest of the economy.
I did not say outsourcing is the only alternative. I said they will have their own people take these jobs or if not, they will ship out these jobs. Do we really believe there aren't enough Americans to handle IT work in America?
H-1b is not cheap labor. American companies prefer to hire H-1bs with US master's degrees or with substantial amounts of US experience. When they do hire foreigners, they do not discriminate against them by paying them lesser.
H-1bs are abused by desi vendors and the like who take advantage of the indenturing nature of the visa and also on the naivety of "fresh off the boat" people who newly arrive into the US and are unfamilar with US economy. They are starry eyed, still busy converting each dollar into their local currency and feeling happy they are earning relatively more and dreaming about paying off their EMIs back home, sooner. It takes quite a few months for them to settle down and understand US dynamics.
Lastly, we should not confuse the need for H-1bs as equal to the need for GC holders. Take the example of middle eastern countries. They use foreign labor, but they never grant them permanent status. That way, they do not get stuck with them in the event of a downturn. American could have chosen to follow a similar model. Use H-1b temps when necessary and send them out when they are expendable. They have no reaons to hand out GCs, like I said earlier. The benefit is all ours.

If that is correct (same category spill over) EB3 has a very very distant hope of getting some spill over when EB3 ROW becomes C and does not use all numbers. I was of the opinion before that the un-used numbers from EB3 ROW will go to EB1 and then EB2 India.
