Thanks for the reply. Here's why it becomes more complicated. I asked my attorney about starting a new EB2 process (I have a MS from US). However, the attorney says he doesn't recommend starting a new PERM process as he strongly believes that this will affect the current EB3 I-140 application. He feels that USCIS will look at the ongoing EB3 application and deem it unnecessary to approve it (as I would have applied for a different position for EB2). Hence I might lose my PD !!
He suggests that I wait till my EB I-140 is approved. But that might take another year considering the slow NSC processing times!!
Any suggestions?

I received my Receipts now for I-485.Is there any process to expedite AP while filing .(based on family death). I'm applying for it now.
You can always take an Infopass appointment. I'm not sure if IO really has authority to generate an interim AP. In my case I took Infopass once for address change as it did not happen even after applying online twice.

You can work upto 240 days after your H1 expiry date while your H1B is pending. To continue working from 241st day, you would need EAD otherwise stop working until the decision is made on H1B.

I-485 pending with PD June 07 & valid EAD
Is it possible to apply for FAFSA for student aid as they require Green Card or US citizenship?
I see on FAFSA website one catagory as eligible non-citizens which includes applicants with I-94 & with atleast 1 yr parole validity.
Is this the same parole as I-131?

Even approved GC and Neutralized Citizenship certificates also can be revoked, if it was found later that there was some fraud involved in it.

Since the AP application is over 90 days pending, you may be eligible to discusss with the customer service. If you do not get good answer, you may be able to schedule an infopass.
We found out at the Infopass that my wife's AP application had been approved 2 months ago. But online system still shows as pending but just got a soft LUD on the date it was approved. So you never know what you may find out.
But not sure if they would give out information to the applicant's spouse

That really sucks.
They (USCIS) take ages to work on our case and when they request something they don't give enough time to respond and even ignore genuine hardship.
I pray sincerely things work out for you. Good luck!

She is travelling with our twins and my father. Seems like there is no way other than for her to do a flying visit or to prepone the trip for everybody.

I travelled thru Frankfurt last december. No need of Transit visa, no hassels; though Air-hostess that hands out I-94 card did not know what AP meant. I boarded at Bangalore airport and Lufthansa staff at check-in were aware of AP. At immigration in chicago, the guy gave me a short lecture- AP should be used only for emergency purpose etc; I jsut nodded and he stamped the I-94 and AP doc

I got stuck in Canada for a week because the PIMS was not up-to-date. Luckily it took only a week but I have heard stories people getting stuck for a couple of weeks. If you are not in the PIMS, the consulate contacts the KCC and they have to research and update the PIMS. Do a find on PIMS and you'll hear a lot of stories.

I would not advise you to port, stick with eb3 as you are working with company A right ? if not then stick with eb2 PD.
