Good news and I am very happy for all Eb2...It seems like EB3 has not much hopes. It is moving at snail's pace, but with all the overflow from EB1 and ROWW going to EB2 only, looks like EB3 will take a long time to reach 2004/2005. If few of us in EB3 category get to see the GC before they leave the US, we should consider ourselves fortunate.

I know out of 3000 members, atleast 2500 would be looking at some forums in this site and posting some messages. WHy dont we show some single, double, triple,... up to 5 stars next to the username based on the contributions.

However, there is not guarantee that people consistently provide same email to site registration and paypal. On top of that, some contributors are not registered users. Hope is ok. But IV core has more access than normal members like lawyers, lobbyists. So their view is important. Atleast interpretation of Memo need to known to the members. Also feasiblity of succcess, amount of effort and money need to be known to the members. I am seeing silent in most lawyer sites like immigration-law, shusterman, ILW. Everyone posted memo but no one really that much bothered

I am working for a fortune 100 company for last 12 years, rose to a senior level position. It's not easy for me to leave my present job and get the same position,level, responsibility and salary and potential for future growth. Except GC I have everythign else, but sometimes the wait is frustrating.
I understand your situation. I was in a similar position and after 8.5 yrs, I had to make a choice and move-on. In my case however, I found a similar position with new employer so I had nothing to lose other than rebuilding the repo at new job. Its very tough to change a job when everything else is going great except for GC, but I was fedup with the wait.

Meanwhile, my lawyer today emailed & confirmed that the h1b will be valid even after using AP to travel and one can also renew or transfer the h1b. Even after the current I-94 expires obtained using AP, if one has still valid EAD or H1B I-797, he/she will be in status. However she also said that this is tricky situation and she could not find any CIS memo.
HOPE THIS WILL STILL SOLVE MANY PEOPLE'S DOUBTS.

My analysis if the law is passed in the current form
1. Non displacement provision will delay H1b process. But innovation will not be impacted as best companies Like Google, Microsoft and start up companies will not have a problem in proving that skills are not available in the market.
2. When a company lays off they cannot recruit for 6 months. But a company is laying off people they will hardly recruit for 6 months. Generally when they do less than 5% of staff that will not come under layoff provision and still they can recruit H1b. So only a few positions will be impacted.
3. 50% rule may make many bodyshoppers and Top indian companies force to recruit US Citizens and medium non public companies may split into many companies. Some H1b dependent small and medium companies may go out of business. It will have huge short term impact on H1b aspirants but they will adjust quickly to change their jobs.
4. More powers for DOL will make the companies to follow the law and reduction of abuse
5. Of course the restrictions will make less number of jobs for H1bs and L1s. But when economy improves demand will increase so that H1b cap will be reached inspite of all these restrictions. I strongly believe that system will adjust the new restrictions similar to TARP bill but short term very high impact. But that can be minimised by applying all those restrictions only for new H1bs. Generally more restrictions the persons qualifying will be best and bright and also wages for H1bs,L1s also will increase with improved working conditions.
6. If pro immigrants like IV can negotiate to include Recapture or increase GC cap. But that depends on chance of passing the bill. If IV and other pro immigrants lobby and block the bill then that makes sense. But if the bill gets bi partisan support then it may be wise to take different approach. This bill may be like 2007 and may not be considered at all.
I did not read the bill completely but my views were based on some major provisions and also I do not believe the conspiracy thoeries that they want to remove the H1b program first then EAD then GCs. But it is a protection for US citizens. I am not arguing that the protection is right or wrong but most countries in the world are trying to do that when recession. India has 100% protection for jobs for Indian citizens

Q.1) I understand you can't file 485 for your spouse if PD is not current but does the PD need to be current to add your spouse as a dependent on your 485 application w/o filing 485 for her?
Q.2) Q.1 raises Q.2. When the dates are no more current, is adding your spouse as a dependent on your 485 safe enuf for her to be considered for filing 485 and getting GC when the dates will be current in future.

Defining employer - employee relationship is different from abuse and we cannot relate these two.
I do agree that to challenge the law rightfully, one has to have credibility.
You are right that employer-employee relationship is different from abuse. However, they are related especially if employer takes legal route.
I wanted to stress thru my post that H1-B worker can not put legal fight for these memo as it has to come from employer. Only time will tell, if or when any employer takes that step.
One thing, I would like to add here is that memo are advisory in nature and they do not have force of law and apply only to USCIS officers, not to immigration judges.

Awesome idea, the problem is , i hope i am wrong; the IV "browsing community" is so fractured and pesimistic. any mention of "paid" membership will turn them off .... maybe thats what we need ... Only serious members who really want to make a difference ....
